Medical doctors are commissioned by the migration authorities and/or border police to assist in decision making about asylum seeker’s requests for residency permits in Sweden. They are asked to: (i) assess the formal written medical opinions made by physicians in support of asylum or humanitarian narratives in the asylum process and/or (ii) to make medical assessments of persons considered for deportation. This arrangement raises questions such as: How is the decision making process carried out? How is medical knowledge used, and (...) who ought to make decisions about medical evidence in the asylum process? Does this approach effect public health overall? There are longstanding concerns that medical assessments to certify whether a person is fit for transport or not, can have a direct, negative impact on persons in need of care and protection. A separate structure of doctors commissioned by the immigration authority seems to raise professional tensions, politicizes medical constructs and contributes to moral disengagement. Empirical data are used to illustrate this discussion with reference to medical issues, medical ethics, public health and legal discourses. I then reflect on key value conflicts using public health ethics theory and conclude with implications for public health ethic theory, policy and practice. (shrink)

Introduction Hundreds of thousands of premature neonates born in low-income countries are implicitly denied treatment each year. Studies from India show that treatment is rationed even for neonates born at 32 gestational age weeks (GAW), and multiple external factors influence treatment decisions. Is withholding of life-saving treatment for children born between 28 and 32 GAW acceptable from an ethical perspective? Method A seven-step impartial ethical analysis, including outcome analysis of four accepted priority criteria: severity of disease, treatment effect, cost effectiveness (...) and evidence for neonates born at 28 and 32 GAW. Results The ethical analysis sketches out two possibilities: (a) It is not ethically permissible to limit treatment to neonates below 32 GAW when assigning high weight to health maximisation and overall health equality. Neonates below 32 GAW score high on severity of disease and efficiency and cost-effectiveness of treatment if one gives full weight to early years of a newborn life. It is in the child's best interest to be treated. (b) It can be considered ethically permissible if high weight is assigned to reducing inequality of welfare and maximising overall welfare and/or not granting full weight to early years of newborns is considered acceptable. From an equity-motivated health and welfare perspective, we would not accept (b), as it relies on accepting the lack of proper welfare policies for the poor and disabled in India. Conclusion Explicit priority processes in India for financing neonatal care are needed. If premature neonates are perceived as worth less than other patient groups, the reasons should be explored among a broad range of stakeholders. (shrink)

The covariant Klein-Gordon equation requires twice the boundary conditions of the Schrödinger equation and does not have an accepted single-particle interpretation. Instead of interpreting its solution as a probability wave determined by an initial boundary condition, this paper considers the possibility that the solutions are determined by both an initial and a final boundary condition. By constructing an invariant joint probability distribution from the size of the solution space, it is shown that the usual measurement probabilities can nearly be recovered (...) in the non-relativistic limit, provided that neither boundary constrains the energy to a precision near ℏ/t 0 (where t 0 is the time duration between the boundary conditions). Otherwise, deviations from standard quantum mechanics are predicted. (shrink)

Provider claims to conscientious objection have generated a great deal of heated debate in recent years. However, the conflicts that arise when providers make claims to the "conscience" are only a subset of the more fundamental challenges that arise in health care practice when patients and providers come into conflict. In this piece, the author provides an account of patient-provider conflict from within the moral tradition of St. Thomas Aquinas. He argues that the practice of health care providers should be (...) understood as a form of practical reasoning and that this practical reasoning must necessarily incorporate both "moral" and "professional" commitments. In order to understand how the practical reasoning of provider should account for the needs and commitments of the patient and vice versa, he explores the account of dependence provided by Alasdair MacIntyre in his book Dependent Rational Animals. MacIntyre argues that St. Thomas’ account of practical reasoning should be extended and adapted to account for the embodied vulnerability of all humans. In light of this insight, providers must view patients not only as the subjects of their moral reflection but also as fellow humans upon whom the provider depends for feedback on the effectiveness and relevance of her practical reasoning. The author argues that this account precludes responsive providers from adopting either moral or professional conclusions on the appropriateness of interventions outside the individual circumstances that arise in particular situations. The adoption of this orientation toward patients will neither eradicate provider-patient conflict nor compel providers to perform interventions to which they object. But this account does require that providers attend meaningfully to the suffering of patients and seek feedback on whether their intervention has effectively addressed that suffering. (shrink)

Mind uploading speculation and debate often concludes that a procedure described as gradual in-place replacement preserves personal identity while a procedure described as destructive scan-and-copy produces some other identity in the target substrate such that personal identity is lost along with the biological brain. This paper demonstrates a chain of reasoning that establishes metaphysical equivalence between these two methods in terms of preserving personal identity.

Jewish and Christian philosophy existed side by side in the Middle Ages. Both sought the same goal: the explanation of God and His universe. Both utilized the same sources; yet each attained different philosophical and theological systems. The Meditation of the Sad Soul illustrates this divergence between Christian and Jewish thought. Furthermore, since it stands midway between Neo-platonic and Aristotelian Judaism, it underlines the development of key philosophical concepts common to both Judaism and Christianity. Abraham Bar Hayya lived in eleventh (...) century Barcelona, an intellectual center for both Jews and Arabs. The major points of his philosophy blend rabbinical, Neo-platonic and Aristotelian ideas, yet maintain a unique independence of their own. For instance, Abraham cut through the rabbinical and Aristotelian proofs of God, demanding instead a primary positive faith in God's existence. Caught up in the theology of light, he rejected the Platonic idea that darkness was merely an absence of light. Rather, darkness had a force equal to light. Most important, darkness and light were opposites, as were good and evil. God created both. Abraham insists that each had an independent existence in the world. Abraham's thought shows a more "rational" strain which appears later in Christian and even Jewish "heresies." Since good and evil exist as positive forces, man can freely choose his path to salvation. Abraham never gets caught in the Augustinian dilemma of will, grace, and predestination. Further examples of Abraham's independent position crop up in his ideas of creation and time. Creation ex nihilo, of course, but creation in time. Time must have a beginning and, consequently, an end. But man does not have to await passively the Messiah's rectification of sin. Man must repent here on earth and actively lead a good life. He cannot repent after death. How influential was Abraham's tract? The editor calls it a "minor classic" yet does not indicate that it formed a basis for later Christian theology. Maimonides knew it and rejected some of its basic tenets. Still, the book is important since it indicates a striking combination of traditional philosophy subjected to a new critical rationalism, an it foreshadows some of the questions raised by deviant Christian and Jewish theologians.--J. This volume brings together flux essays by an eminent scholar on the origins, development, and import of Kant's philosophy, chiefly in its metaphysical aspects. Four of these were separately published between 1924 and 1926, but until now have been difficult to obtain, despite great demand. Their appearance here will be welcomed. The thesis emerging from these studies is that the critical philosophy originates in metaphysical probings concerning the nature and presuppositions of being, and issues in doctrines which, despite psychological, epistemological, (...) and ethical presentation, are intended to have definite ontological import. --L. Part I aims at the constructive establishment of a concept of the self to undergird the theologically indispensable concept of the soul. It begins with a judgment theory of cognition, from which a "substantival" subject is extracted. Having a creative power constituting it a free and responsible agent, this subject is related through moral consciousness and will to an objective moral order. Part II, concerned with the problem of God and the objective validity of religious belief, begins in religion as (...) such, where theism is held to recommend itself strongly under a symbolic interpretation, then develops a metaphysical support for the central tenets of this creed. The guiding methodological convictions are revealed in a major emphasis on introspection, a firm rejection of the sensationalist conception of experience, and an insistence on the primacy of thought over words. Professor Campbell has here carried on the tradition of British Idealism and Rationalism with insight and ingenuity, in dignified and deliberate defiance of the prevailing empiricist and linguistic dogmas. Despite its high rank among similar efforts, however, this work does not represent a real advance beyond the recent impasses, nor a resolution of the genuine epistemological and methodological enigmas plaguing contemporary philosophy. --L. A time-symmetric formulation of nonrelativistic quantum mechanics is developed by applying two consecutive boundary conditions onto solutions of a time- symmetrized wave equation. From known probabilities in ordinary quantum mechanics, a time-symmetric parameter P0 is then derived that properly weights the likelihood of any complete sequence of measurement outcomes on a quantum system. The results appear to match standard quantum mechanics, but do so without requiring a time-asymmetric collapse of the wavefunction upon measurement, thereby realigning quantum mechanics with an important (...) fundamental symmetry. An over-compact but vivid metaphysical scheme woven out of categories such as process, endurance, self-realization, etc., and stressing a contrast between "cosmic" reality, a perpetual activity whose unity lies in the urge for endurance of which it is the self-realization, and "anthropocosmic" reality, a perishing complex of realized finite purposes. The vocabulary and style are obscure, and originality is more is evidence than fruitfulness.--L. K. B.

The wounds inflicted by Homer's warriors fascinate readers, since they are vividly described and often curious or even grotesque. Commentators have struggled to explain some of them since commentaries began: some of the explanations are more curious than the wounds. Not surprisingly, the commentaries have not usually been graced by a high standard of anatomical or, especially, physiological background knowledge, and are often misleading in these respects. When such knowledge is applied, some wounds which have appeared problematic become realistic, but (...) some which have been accepted as straightforward become problematic. (shrink)
